The
U.S. Department of State has released a major update to the Exchange Visitor
Skills List, set to take effect on December 9, 2024. This marks the first
significant revision in 15 years, eliminating the two-year home-residency
requirement for J-1 visa holders from 34 countries, including China, India,
South Korea, Saudi Arabia, and the UAE. This update is positioned to have a
profound impact on individuals, employers, and U.S. innovation, opening new
opportunities for skilled professionals and enhancing talent retention in the
U.S.
The
Exchange Visitor Skills List designates countries and areas of expertise
considered crucial for a nation's development. Historically, foreign nationals
from these countries holding J-1 visas were obligated to return to their
country of citizenship or last legal permanent residence for at least two years
after completing their program. The revised list removes this requirement for
34 countries, signaling a significant policy shift focused on retaining talent
in the U.S.
